The features, information, programs, and services you will find here, (this “Site”) are owned by Brit Stueven, LLC, a Colorado limited liability company.
THIS IS A CONTRACT
All visitors to this Site, and all participants in any of the Mama Be Present content or Brit Stueven’s programs (the “Program”), are “Participants“, whether registered or not, and are agreeing to the terms of this Terms of Use. Participants are sometimes called “you” in these Terms of Use. All references to “the Site” includes the Program.
BY USING THE SITE OR PARTICIPATING IN THE PROGRAM YOU ARE AGREEING TO THESE TERMS OF USE. IF YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT, DO NOT ACCESS OR USE ANY PART OF THIS SITE OR THE PROGRAM. As used in these Terms of Use, “we,” “our” and “us” means Brit Stueven, LLC.
Relaxation, Self-Awareness and Personal Improvement Overview; Participant Responsibility
Participating in any of Brit Stueven’s programs involves a willing relationship between you, the Participant and the “Program Leader” (the experience guide, who creates informational, inspirational content in the form of subscription-based email nudges, blogs and social media posts for Participants). The Program Leader provides information for Participants to apply to their own daily lives, then communicates information back to personal partners, the Program Leader, or online group. Programs are intended to be informational and educational for the Participant, and to provide information, support and encouragement for the Participant’s goals and decisions based on information provided by the Participant. Participant is fully and solely responsible for all information provided to the Program Leader and online community, all information communicated back to the Participant by the Program Leader, and all Participant decisions, actions or inactions resulting from or relating to the program experience. Participant will indemnify and hold harmless Brit Stueven, LLC, and its owners, members, officers, agents, employees, contributors, participants, affiliates and representatives from any claims, liability, costs or expenses arising directly or indirectly from Participant’s participation in or use of Brit’s programs and any related services, information or materials.
Brit Stueven, LLC, does not guarantee or warrant any particular outcome, result or success from these personal improvement programs, and expressly disclaims any such guarantee or warranty.
Not a Substitute for Medical, Legal or Other Advice
Participation in any of Brit’s courses is not a substitute for medical, psychological, psychiatric, wellness, therapeutic or other diagnosis, care, counseling, advice, consulting or treatment, or for any medicine. Likewise, this Site and the Programs are for informational and entertainment purposes only and not intended to replace or substitute for any professional psychological, medical, legal, financial or other advice. We make no representations or warranties and expressly disclaim any and all liability concerning any treatment or action by any person following the information offered or provided within or through the Site or any Program. If you have specific concerns or a situation in which you require professional, medical or counseling advice, you should consult with an appropriately trained and qualified specialist.

RULES OF USE
You are responsible for all of your actions on this Site and in connection with the Program, and you may not engage in any behavior that violates these Terms of Use.
You must comply with all applicable laws, ordinances, rules, and regulations regarding use of the Site and Program, and will not access the Site from jurisdictions where it is illegal or prohibited. Participants are responsible for complying with all local rules, laws, and regulations.
You promise you shall not use the Site to engage in, or assist others to engage in, any of the following:
- Transmit or communicate any data that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;
- Sublicense to, transfer, network, transmit, distribute, or permit use of the Site by any third party
- Forge headers or otherwise manipulate identifiers in order to disguise the origin of any data transmitted to other Participants;
- Stalk or otherwise harass another person;
- Modify, delete or damage any information contained on the personal computer of any other Participant;
- Upload, post or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation;
- Promote terrorism, abuse, libel, hate, personal injury, property damage, violence, or intolerance
- Defame any person
- Collect information about others (such as e-mail addresses or other personally identifiable information) without their consent
- Upload, post, use or otherwise make available any content that contains software viruses or any other corrupt computer code, files or programs that impair the use of any computer software or hardware or telecommunications equipment
- launch any automated system, including without limitation, “robots,” “spiders,” “offline readers,” etc., that accesses the Site in a manner that sends more request messages to our servers than a human can reasonably produce in the same period of time by using a conventional on-line web browser
USER CONTENT – USERS’ POSTS
Forums, message boards, chat rooms, group emails, networking areas, blogs, comment features, or other interactive areas on the Site (collectively, “Participant Forums“) are provided to give Participants a place to express their opinions and share their ideas and information. Participants may be able to upload or otherwise submit information, data, messages, suggestions, photographs, audio, video, text, and other materials to the Site through Participant Forums and other Site features (“Participant Content“). We do not endorse the Participant Content. We reserve the right, but are not obligated, to reject, delete, move or edit Participant Content in whole or in part, for any reason in our sole discretion, and to suspend or terminate your access to the Site and pursue all legal remedies if we believe your Participant Content infringes another’s copyright or otherwise violates any law, rule or regulation.
You are solely responsible for the content you post on the Site including but not limited to photos, text, videos, graphics, and personal profiles. Brit Stueven, LLC does not take any responsibility for the accuracy of any information, ideas or opinions posted by Participants. By posting any information or other content on the Site, you have authorized Brit Stueven, LLC to publish such materials in any manner desired without any obligation to compensate you or anyone else.
If you post personal information in Participant Forums or on other publicly available areas of the Site then you may receive unsolicited communications or messages from third parties. Under no circumstances will we be liable in any way for any of your Participant Content. Your Participant Content will be treated as non-confidential and non-proprietary and we will not be liable for any use or disclosure to anyone, including but not limited to claimed intellectual property owners.
Brit Stueven, LLC may monitor and delete any content that we, in our sole discretion, believe violates the terms of the these Terms of Use or which may be illegal or offensive, or which poses a threat to the rights or safety of other Participants. Prohibited content includes anything that:
- Is unlawful, defamatory, harassing, inciting, threatening, hateful, harmful, bigoted, racially offensive or otherwise objectionable;
- Interferes with another user’s rights to privacy;
- Displays sexually explicit material of any kind;
- Encourages criminal conduct, gives rise to civil liability or violates any law or regulation;
- Contains any personally identifiable information about another use without that person’s express consent;
- Uses false or misleading e-mail addresses or impersonates any person or entity, or falsely states or misrepresents your affiliation with a person or entity;
- Posts any trademarks, logos, copyrighted material or other intellectual property without the authorization of the owner;
- Posts any materials that may damage the operation of a computer (such as a virus worm or Trojan horse); or
- Advertises or sells any goods or services
Any Participant who feels that a posted message is objectionable is encouraged to contact us immediately by email. We have the ability to remove objectionable messages and we will make every effort to do so, within a reasonable time, if we determine that removal is necessary.
Brit Stueven, LLC is a provider of an interactive computing service as set forth in the Communications Decency Act, 47 U.S.C. §230 and expressly reserves its rights to not be treated as the publisher or speaker of any information provided by another information content provider on the Site.
By posting any content on the site, you expressly grant, and you represent and warrant that you have a right to grant, to Brit Stueven, LLC a royalty-free, sublicensable, transferable, perpetual, irrevocable, non-exclusive, worldwide license to use, reproduce, modify, publish, list information regarding, edit, translate, distribute, publicly perform, publicly display, and make derivative works of all such Participant content including, without limitation, your name, voice, or likeness as contained in your Participant content, in whole or in part, and in any form, media or technology, whether now known or hereafter developed for use in connection with the Service.
You hereby irrevocably assign all worldwide rights, title and interest in and to all of your Participant content posted; and, hereby waive and release Brit Stueven, LLC from any claims that you now have or may hereafter have, known or unknown relating to or resulting from your Participant content including, without limitation, infringement or violation of any privacy right or obligation of confidentiality.
No Participant Submissions
We do not accept or consider creative ideas, suggestions or materials that we do not specifically request from you. We ask that you do not submit or send any such materials directly to us. If you send creative suggestions, ideas, notes, drawings, concepts, materials or other information to us, such creative material shall become our property, and we have the right to display, copy, use, sublicense, transmit, publicly perform or publish such material for any purpose we desire. In addition, you waive all “moral rights” in the materials and agree that none of the material shall be subject to any compensation, obligation of confidentiality on the part of Brit Stueven, LLC.
DISCLAIMER OF WARRANTIES
Except as otherwise expressly provided, all content, information, services and tools and on this Site are provided on an “As Is”, “As Available” basis. Use of this Site is solely at your own risk.
THE SITE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR COURSE OF PERFORMANCE. We care about the privacy of our Participants. By using this Site, you are consenting to have your personal data transferred to and processed in the United States.
We are a ‘data controller’ under the EU General Data Protection Regulation and California law, and we may collect some ‘personally identifiable information’ as covered by the laws of other states. Information that you submit to Brit Stueven, LLC may be transferred to countries outside the European Economic Area (“EEA”). For example, our servers are in the United States.
This site is intended for a United States audience. Information Collected from Children
This Site is not directed at children under the age of 16. It is a general audience site with content directed primarily at individuals 16 and over. We do not knowingly collect personally identifiable information from children under the age of 16 without verifiable parental consent and unless expressly identified on specific pages of our Site. If you are under the age of 16, please do not provide personally identifiable information of any kind whatsoever. If a child does provide us with personally identifiable information, a parent or guardian of that child may contact us by sending an e-mail to brit@britstueven.com. Upon notification, we will delete from our records any information collected from children under the age of 16.

We do not rent, sell, or share your personal data with other people or nonaffiliated companies except to provide products or services you’ve requested, when we have your permission, or under the following circumstances:
- We respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims;
- We believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our User Agreement, or as otherwise required by law;

We may display advertisements on our Site. Advertisers may assume that people who interact with, view, or click on targeted ads meet the targeting criteria. We do not otherwise actively provide any personal data to the advertiser when you interact with or view an ad.
Non-U.S. Users
If you are located outside of the United States, the information you provide to us will be transferred to the United States. By using this Site, you consent to this transfer. You also consent to the adjudication of any disputes arising in connection with this Site through binding arbitration in, and in accordance with the laws of, the state of Colorado.

In addition, if you indicated upon registration that you are interested in receiving information from us, we may occasionally send you direct mail. If you do not want to receive such mailings, simply tell us when you give us your personal information. What security precautions are in place to protect against the loss, misuse, or alteration of your information?
At our site you can be assured that your Personal Information is secure, consistent with current industry standards. The importance of security for all Personal Information associated with our users is important to us. Your Personal Information is protected in several ways. As a result, while we strive to protect your Personal Information, you acknowledge that: (a) there are security and privacy limitations of the Internet which are beyond our control; (b) the security, integrity and privacy of any and all information and data exchanged between you and us through this site cannot be guaranteed; and (c) any such information and data may be viewed or tampered with in transit by a third party.
We maintain reasonable administrative, technical, and physical safeguards designed to protect the information that you provide on this site. However, no security system is impenetrable and we cannot guarantee the security of our site, nor can we guarantee that the information you supply will not be intercepted while being transmitted to us over the Internet, and we are not liable for the illegal acts of third parties such as criminal hackers.
